Terms and conditions of sale

Purpose of the lease

The present rental is subject to the provisions of articles L324-2-1 et seq. of the French Tourism Code and articles 1714 to 1762 et seq. of the French Civil Code.

The present rental constitutes a seasonal rental and is entered into as a temporary residence and for pleasure. Under no circumstances may the tenant establish his or her principal residence in the property, nor may he or she engage in any commercial, craft or professional activity.

Seasonal rental duration

The chalet is made available to the tenant for the period indicated in the Special Conditions, from the agreed arrival date at 5 pm to the agreed departure date at 10 am.

The tenant expressly undertakes to have vacated the chalet in full by 10 a.m. at the latest on the agreed date of departure, and to pay the balance of any expenses incurred prior to departure.

Rental prices, charges, fees and taxes

The rent fixed in the Special Conditions for the rental of the chalet described in paragraph I.b. and for the period defined in the Special Conditions, includes payment of the rental charges and available supplies listed below:

Provision of accommodation, bed linen, towels, toilet paper and cleaning products.

The price includes all taxes (except tourist tax), but excludes any optional services.

Optional services: These must be paid for no later than the day of departure, failing which they will be deducted from the security deposit. These optional services can be :

– Additional cleaning services or sheet changes expressly requested by the tenant.

– All services not included in article e. of the Special Conditions and ordered by the Tenant from the concierge service.

Security deposit

The deposit is guaranteed by a credit card at the time of arrival, and at the latest within 24 hours of arrival.

This deposit is intended for :

– to be liable for any damage caused to the occupied property or to any movable objects therein during the period of occupancy. The latter is automatically released if no damage is noted within 2 weeks of the Tenant’s departure.

Rental damage includes all damage to and deterioration of the accommodation, as well as damage, loss or theft of personal property during the rental period.

– to pay for any optional services not settled before departure.

What happens to the damage deposit :

  • If the Chalet is returned in the same condition as it was on arrival, and all optional services have been paid for, the deposit will not be debited.
  • If minor damage or deterioration is noted or if optional services have not been paid for, the credit card will be debited on the basis of the rates for repairs, optional services, etc. displayed in the accommodation.
  • In the event of major damage or deterioration, the deposit will be debited immediately. Any balance remaining after deduction of repair, refurbishment or replacement costs will be returned within 2 months.

Tourist tax

Tourist tax is not included in the rental price. It will be invoiced by the agency at the end of the stay, and paid to the commune of XXX.

Assignment and sublease

The present seasonal rental contract is concluded for the sole benefit of the Tenant signing the present contract. The transfer of the lease, total or partial subletting, is strictly forbidden.

Current situation

An inventory / inventory / photo report will be given to the Tenant on the day of entry to the chalet. The Tenant has 24 hours to report any anomalies. If the document is not signed within 24 hours, it will be considered accepted.

The property will be controlled by the Owner after the rental period.

If any damage, not apparent at the time of departure, is subsequently found, the tenant will be informed within a week.

Lessee’s obligation

The Tenant shall make peaceful use of the rented accommodation. He will return it in a good state of cleanliness. He must respect the neighbors.

He undertakes to make normal and reasonable use of the means of comfort (heating, air conditioning, water, etc.), as well as of the equipment (household appliances, multimedia, kitchen, etc.) made available to him.

He undertakes to inform the agency as soon as possible of any breakdown, damage, incident or malfunction.

The Tenant is responsible for the use of the Internet access provided during the rental period.

Pets

Unless exceptionally authorized in writing by the agency, in agreement with the owner, pets are not allowed in the chalet.

Holiday insurance

As the tenant is responsible for any damage caused to the chalet (furniture or real estate), he/she must provide the agency with a certificate of holiday insurance, specifying that the rented property is covered. (Only for French or Swiss customers, others do not systematically have RC)

Cancellation – Modification – Interruption of stay – Late arrival – Late departure

  • Modification by the Lessor :

For reasons of force majeure and/or for safety or maintenance reasons, the agency may be obliged to partially or totally modify the Tenant’s stay. The Tenant will be informed in writing (by registered letter or e-mail). In such a case, the Tenant may either terminate the contract and obtain a free refund of the sums paid, or accept the modification proposed by the agency, an amendment to the rental contract being signed between the parties.

  • Tenant modification:

It must be notified to the agency in writing (registered letter or e-mail).

The agency will do its utmost to satisfy the Tenant’s request for modification. If this is not possible, the modification will be considered as a cancellation, and the rules set out below will apply.

  • Cancellation :

It is advisable to take out insurance to cover cancellation costs.

Cancellation before the start of your stay will be charged as follows:

o In the event of cancellation more than 30 days before arrival: 25% of the total cost of the stay.

o In the event of cancellation less than 30 days before arrival: 100% of the total cost of the stay.

  • Interruption of stay :

If the stay is interrupted, even for medical reasons or force majeure, the Tenant cannot claim any refund. To cover this eventuality, it is advisable to take out an insurance policy with an insurance company.

  • Late arrival:

The rental period cannot be extended and I will be billed in full.

  • Late departure :

The Tenant will be subject to additional charges corresponding to the price of one night’s accommodation booked, unless the agency has previously agreed to this late departure.

Liability

The agency cannot be held responsible for loss or theft in the chalet. Each Tenant is responsible for his or her own actions. They are responsible for their own use of the safe, if the chalet is equipped with one, and of the equipment and other services made available to them.

However, even if the safe is used, the agency cannot be held liable.

The Tenant may be held responsible in the event of missing or damaged items in the chalet, as indicated above under the paragraph relating to the security deposit. The amount of repairs will be deducted from the security deposit and/or invoiced at the end of the Tenant’s stay. Each Tenant is responsible for any nuisance caused by persons staying with him/her in the chalet.

Cancellation

In the event of breach by the Tenant of any of his contractual obligations, in particular if the peace, integrity or safety of people living or working in the chalet is endangered, the present contract will be terminated ipso jure. Such termination shall be effective immediately upon notification by any means capable of providing proof. (Registered letter, hand-delivery, bailiff, e-mail, etc.).

Home

For the execution of the present contract, the Owner and the Tenant elect domicile at their respective addresses, indicated in the header of the present contract. However, in the event of a dispute, the Lyon court shall have sole jurisdiction. The present contract is subject to French law.
